Privacy Policy

The short version

Here’s what we actually do with your information, without the legal fog. The full policy is below and it’s the one that governs.

We do not sell your data. Not to brokers, not to lead lists, not to anybody. We never have.

What we collect. What you type into a form (name, email, phone, date, venue, project details), what your browser tells us automatically (IP, device, pages viewed), and what our analytics and ad tools record about your visit.

Heads up on session recording. We run Microsoft Clarity, which records mouse movement, clicks, and scrolling on real visits so we can see where the site confuses people. It’s anonymized. If that bothers you, Section 5 tells you how to turn it off.

Advertising is the nuance. We don’t sell data, but we do run Meta and Google ads, and those platforms use your visit to target ads. Under Texas and California law that counts as “targeted advertising” and you have the right to opt out. Section 10 shows you how.

Photos are personal data. If we photograph you, that image is information about you. We handle it accordingly, and Section 4 explains what we do with it and how portfolio use works.

You have rights. See it, correct it, delete it, get a copy, opt out. Email us and we’ll handle it. If we say no, you can appeal, and Section 11 tells you how.

Kids. The site isn’t for anyone under 18. We photograph minors only with a parent or guardian’s involvement, and we don’t publish a minor’s image without permission.

1. Scope and who we are

1.1 This Privacy Policy explains how Gabe Rene LLC (“Gabe Rene LLC,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information.

1.2 Gabe Rene LLC is a Texas limited liability company based in Kerrville, Texas. This Policy covers gaberene.com and every other website, subdomain, landing page, client portal, form, and online offering we operate that links to it, plus the offline collection of information in the course of our services.

1.3 Gabe Rene LLC operates through divisions and assumed names, including GR Weddings, GR Studio & Co., GR After Dark, GR Portraits, and Trendy Booth. Each is a division of Gabe Rene LLC, not a separate entity. Some divisions publish a supplemental policy that adds detail specific to that division. Where a supplemental policy conflicts with this one, the supplemental policy controls for that division.

1.4 “Personal information” means information that identifies, relates to, describes, or could reasonably be linked with an identified or identifiable individual. Some laws call this “personal data.” We use the terms interchangeably.

2. Information you give us

We collect what you choose to provide, including:

We do not require you to provide sensitive personal information. If you volunteer it (for example, health or accessibility needs relevant to shoot day, or dietary information for an event), we use it only for that purpose.

3. Information collected automatically

3.1 When you visit, we and our service providers automatically collect:

(a) Device and connection data: IP address, browser type and version, operating system, device type, screen size, language, and referring URL.

(b) Usage data: pages viewed, time on page, scroll depth, clicks, navigation paths, entry and exit pages, and dates and times of access.

(c) Session activity: through Microsoft Clarity, a recording of mouse movement, clicks, taps, and scrolling during your visit, presented to us as anonymized session replays and heatmaps. Clarity masks text input by default.

(d) Advertising and conversion data: identifiers and event data used by Google Ads, Google Analytics 4, and Meta to measure and attribute advertising, including through server-side Conversions API events.

3.2 We collect this using cookies, pixels, tags, local storage, SDKs, and server logs. See Section 5.

4. Photographs, video, and audio

4.1 Photography and film are our business, and an image or recording of you is personal information about you. We treat it that way.

4.2 What we do with it. We capture, edit, back up, store, and deliver images and video to perform the services you or an event host engaged us to perform. We keep redundant backups on multiple drives and in cloud storage.

4.3 Portfolio and marketing use. We may use selected work in our portfolio, on our websites, on social media, in proposals, in printed samples, in competition or publication submissions, and in advertising. This use is governed by the terms of your signed Service Agreement or model release. Where your agreement restricts or prohibits that use, we honor the restriction.

4.4 Boudoir and GR After Dark. Images produced by our GR After Dark division are never used in any marketing, portfolio, social, or public context without separate, specific, written consent that is distinct from the service agreement. Consent is opt in, never assumed, and may be withdrawn in writing at any time as to future use.

4.5 Event guests. At weddings and events, we photograph guests who are not our clients. Our legal basis is our legitimate interest in performing the contract with the host and documenting the event. If you were photographed at an event and want your image excluded from our marketing, email us and we will honor it. Removing an image already delivered to the client or already printed is not always possible, and we will tell you plainly what we can and cannot do.

4.6 Recordings of calls and meetings. We may take notes or record discovery and planning calls to build your project plan. We tell you before recording and we do not record without consent.

5. Cookies and tracking technologies

5.1 We use the following categories:

(a) Strictly necessary. Required for the site to function, including security and load balancing. These cannot be turned off.

(b) Analytics and performance. Google Analytics 4 and Microsoft Clarity, to understand how the site is used and where it fails people.

(c) Advertising. Google Ads and Meta Pixel, plus planned Pinterest and LinkedIn tags, to measure campaigns and to show you our ads on other platforms.

(d) Functional. Preferences and settings that improve your experience.

5.2 Tags are deployed through Google Tag Manager.

5.4 Global Privacy Control. We honor the Global Privacy Control (GPC) signal as a valid request to opt out of targeted advertising and any sharing of personal information, where required by applicable law.

5.5 Do Not Track. Browsers offer a “Do Not Track” setting, but there is no consistent industry standard for responding to it. We do not currently respond to DNT signals. We do respond to GPC.

5.6 Consent banner and Consent Mode. This site presents a cookie consent banner and operates Google Consent Mode v2, so analytics and advertising tags respect your choice. Non-essential cookies do not load until you consent. You can change your decision at any time through the “Cookie Preferences” link in the footer.

6. Information from third parties

We may receive information about you from:

(a) our advertising and analytics partners, in aggregated or hashed form; (b) social media platforms, when you interact with our content or message us; (c) your event host, planner, venue, or other vendors working on your project; (d) publicly available sources and business data providers, when we research a prospective or current commercial client’s brand; (e) referral sources and past clients who refer you; and (f) payment processors, confirming transaction status.

7. How we use information

We use personal information to:

(a) respond to inquiries and provide quotes and proposals; (b) enter into and perform service agreements; (c) plan, schedule, staff, and deliver shoots, events, and projects; (d) edit, deliver, host, and back up photographs, video, and other deliverables; (e) invoice, process payments, and keep financial and tax records; (f) provide customer support and communicate about active projects; (g) send marketing communications you have opted into; (h) operate, secure, debug, and improve our websites and services; (i) measure and optimize advertising and marketing performance; (j) conduct brand, market, and competitive research for commercial clients; (k) protect our rights, enforce our terms, and prevent fraud and abuse; and (l) comply with legal obligations.

8. Legal bases (for individuals in the EU, EEA, and UK)

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing before withdrawal.

9. How we share information

9.1 We do not sell personal information for money, and we have not in the preceding twelve months.

9.2 We share personal information with:

(b) Contract crew. Second shooters, videographers, editors, retouchers, drone operators, and booth attendants engaged for your project. They are bound by confidentiality obligations and may use your information only to perform the work.

(c) Vendors on your project, where coordination requires it. At a wedding, that may mean sharing a timeline with your planner, venue, or DJ. We share only what the job requires.

(d) Professional advisors, including our attorney, accountant, and insurers.

(e) Legal and safety recipients, where we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of any person.

(f) A successor, in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business. We will notify you if your information becomes subject to a materially different privacy policy.

9.3 Targeted advertising. We use Google and Meta advertising products. Under the Texas Data Privacy and Security Act and the California Consumer Privacy Act, disclosing identifiers to those platforms for advertising purposes may be treated as “targeted advertising,” and under the CCPA as “sharing” for cross-context behavioral advertising, even though we receive no money. You have the right to opt out. See Sections 5.3 and 10.

9.4 We do not disclose sensitive personal data for any purpose that would require consent under applicable law without first obtaining that consent.

10. Your privacy rights

10.1 Depending on where you live, you may have some or all of the following rights. We extend these rights to every person who asks, regardless of residency. It is simpler than sorting people by state, and it is the right way to run this.

10.2 How to exercise a right. Email gabe@gaberene.com with the subject line “Privacy Request,” or write to us at the address in Section 16. Tell us what you want and enough information for us to find your records.

10.3 Verification. We will take reasonable steps to verify your identity before acting, usually by confirming information already in our records or by emailing the address on file. We will not ask you for more sensitive information than the request requires.

10.4 Authorized agents. An agent may submit a request on your behalf with written proof of authorization. We may still contact you to confirm.

10.5 Timing. We respond within forty-five (45) days. If we need more time we will tell you within that period and may extend by another forty-five (45) days. For EU and UK requests, we respond within one (1) month, extendable by two (2) further months for complex requests.

10.6 Cost. Free, once per twelve-month period. We may charge a reasonable fee for manifestly unfounded, excessive, or repetitive requests, or decline them, and we will tell you why.

10.7 Limits. We may decline a deletion request where we must keep information to complete a transaction, comply with a legal obligation, exercise or defend legal claims, maintain financial and tax records, or where the information is part of a work in which we hold copyright. We will always tell you the specific reason.

11. Appeals (Texas and other states)

11.1 If we refuse to act on your request, you may appeal.

11.2 Send your appeal to gabe@gaberene.com with the subject line “Privacy Appeal,” within a reasonable time after receiving our decision. Include your original request and why you think the decision was wrong.

11.3 We will review and respond in writing within sixty (60) days, explaining the reasons for our decision.

11.4 If we deny your appeal, you may complain to the Texas Attorney General at texasattorneygeneral.gov/consumer-protection, or to the attorney general or supervisory authority in your own jurisdiction.

12. Data retention

12.1 We keep personal information only as long as necessary for the purposes described in this Policy, or as required by law.

12.2 When retention ends, we delete or de-identify the information.

13. Security

13.1 We use reasonable administrative, technical, and physical safeguards, including encrypted transmission (HTTPS/TLS), access controls and strong authentication on business accounts, password-protected client galleries and delivery portals, redundant encrypted backups, and limiting access to the people who need it.

13.2 No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you provide information at your own risk.

13.3 If a breach affecting your personal information occurs, we will notify you and the appropriate authorities as required by applicable law, including Texas Business and Commerce Code ยง 521.053.

14. Children’s privacy

14.1 The Site is not directed to children and we do not knowingly collect personal information online from anyone under 13, consistent with the Children’s Online Privacy Protection Act. If we learn we have, we will delete it. Contact us if you believe a child has provided us information.

14.2 The Site is intended for users 18 and older.

14.3 Photographing minors. We regularly photograph minors at weddings, family sessions, senior sessions, and events. We do so with the involvement of a parent or legal guardian, and we do not publish a minor’s image in our marketing without a parent or guardian’s written permission. A parent or guardian may withdraw that permission for future use at any time by emailing us.

15. International transfers

15.1 We are based in the United States and our service providers are primarily in the United States. If you are outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

15.2 Where we transfer personal data out of the EEA or UK, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, or on a derogation permitted under Article 49 of the GDPR, such as your explicit consent or the necessity of the transfer for performance of a contract with you (which is generally the case for a destination wedding).

16. Third-party links

The Site links to third-party sites and platforms. We are not responsible for their privacy practices. Read their policies before providing them information.

17. Changes to this policy

We may update this Policy. When we do, we will change the “Last updated” date above. For material changes we will provide additional notice, such as by email or a prominent notice on the Site. Your continued use after the effective date of a change constitutes acceptance.
